DUTY TO CO-OPERATE
Although the Local Plan asserts at paragraph 2.5 that the Duty to Cooperate has been applied, there is no
evidence of this, and therefore our Client must register an objection to this and reserve the right to submit
further representations once the Duty to Cooperate document is made available. This is important because
it will indicate how ABC is responding to unmet housing needs across the market area.

4.1.1 The Duty to Cooperate is a legal requirement established through Section 33(A) of the Planning and
Compulsory Purchase Act 2004, as amended by Section 110 of the Localism Act. It requires local

Duty to cooperate (paragraph 2.5)
The Local Plan is unsound with regard to the duty to cooperate.
The Local Plan has not demonstrated that the duty to cooperate has been discharged since it is unsupported by adequate evidence to describe what the cross-boundary strategic issues are that affect Ashford.
