SECTION 103 HOUSING ACT 1985: LANDLORD’S PRELIMINARY NOTICE OF VARIATION OF TENANCY TERMS


Ashford Borough Council is proposing some updates to its introductory and secure tenancy agreement. This page explains why the changes are being made and how you can give us your views before anything is finalised.

Why we are proposing changes

We are updating the tenancy agreement so that it:

  • Reflects new Council policies that have been approved since the last agreement was updated, such as the Pet Policy 2023
  • Includes clearer wording and new clauses to help both tenants and the Council understand their rights and responsibilities more easily.

As required by law, we must consult with you before these changes are made. Once the consultation is complete, and after considering everyone’s feedback, the updated agreement will become your new tenancy agreement.

Please do not sign or return the draft tenancy agreement enclosed with the letter. It is for consultation only.

This Preliminary Notice of Variation and the draft agreement are served in accordance with Section 103 of the Housing Act 1985, as we intend to serve a Notice of Variation to change the terms of your tenancy agreement after the consultation concludes.

Consultation

After the consultation period, we will review all feedback and may make further changes to the draft agreement you have been sent, to reflect the feedback we receive.

We expect the new tenancy agreement to take effect from Monday the 27th of July 2026 but we will confirm the final date when we send the formal Notice of Variation.

We ask that feedback is received by noon on the 6th of July 2026.
